Intelligence agencies and law enforcement, ranging from Five Eyes to your local police department, have the technical capability to silently power on your cell phone and activate your microphone when your phone was turned off. Intelligence agencies' official mantra, according to their documents, is to "collect it all." They don't care about conducting surveillance on specific targets like terrorists, it is their goal to collect bulk amounts of content from entire populations as evidenced in UPSTREAM, MYSTIC, and the like.
